Meaning of Equality, Legal and Social Equality (ISC Class 11 Political Science)

Updated 17 October 2026 · Fact-checked

Equality does not mean identical treatment; it means equal moral worth, no special privilege, adequate opportunities for all and reasonable differences in treatment to help the disadvantaged. Legal equality (Article 14) means equality before the law and equal protection of the laws; social equality (Articles 15 and 17) means no discrimination by caste, religion or sex and the end of untouchability.

Treating everyone identically can still exclude; reasonable differences like ramps or reservations give all people a real, equal chance.

Understand Meaning of Equality, Legal and Social Equality

Meaning. Modern ideal: "Liberty, Equality, Fraternity" of the French Revolution and "all men are created equal" in the American Declaration of Independence. It means (1) equal moral worth and dignity; (2) no special privilege by birth, caste, race, religion, sex or wealth; (3) adequate opportunities to develop, such as education; (4) reasonable classification: different treatment based on relevant differences to help the disadvantaged (reservations for SCs and STs under Articles 15(4) and 16(4), ramps for persons with disabilities). Laski: first, the absence of special privilege; second, adequate opportunities for all. It does not mean identical treatment or equal rewards regardless of effort or need, nor denying natural differences. Rousseau distinguished natural inequalities (strength, ability) from social inequalities created by society (privilege, property, caste); equality seeks to remove unjust social inequalities.

Legal equality. All are equal before the law and entitled to equal protection of the laws. Equality before the law (negative, British practice, Dicey's rule of law): no one is above the law and all are tried in the same courts. Equal protection of the laws (positive, US Constitution): like circumstances treated alike, reasonable classification allowed. India: Article 14; Article 39A free legal aid; exceptions: Article 361 for the President and Governors, and diplomatic immunity. Problems: costly litigation, delay and lack of awareness.

Social equality. Equal status and dignity with no discrimination by caste, race, religion, sex, place of birth or class: no hierarchy by birth, equal access to public places, equal status for women and men, respect for diversity. India: Article 15 (no discrimination; 15(4) special provisions), Article 17 (abolition of untouchability), Protection of Civil Rights Act (1955), SC/ST (Prevention of Atrocities) Act (1989). It needs changes in attitudes as well as laws.
